Terms of Service

1. Acceptance of terms

By creating an account or using Analyst, ProfitFalcon, ClientFalcon, or any related BizFalcon AI product or website (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and BizFalcon AI ("BizFalcon", "we", "us"), the company that operates Analyst and its product suite, including ProfitFalcon and ClientFalcon.

2. The Service

The Service provides analytics, reporting, and AI-generated insights over data you upload or connect. Features and limits depend on your subscription plan. The Service may change without notice.

3. ProfitFalcon: the Service

ProfitFalcon provides analytics, reporting, and AI-generated insights over data you connect from third-party platforms.

4. ClientFalcon: the Service

ClientFalcon provides agency-grade marketing reporting and AI-generated insights over the ad and analytics data you connect.

5. Analyst: the Service

Analyst provides AI-powered data analysis tools that allow users to upload CSV, Excel, and other data files, connect to data sources, and receive automated insights, charts, and forecasts.

6. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for activity under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend accounts that violate these terms.

7. Subscriptions, billing and refunds

Paid plans are billed in advance on a monthly or annual basis via Stripe. Subscriptions renew automatically until cancelled. You may cancel at any time; access continues through the period you have paid for.

Refunds. If the Service does not work for you, email support@bizfalconai.com within 30 days of a charge and we will refund it in full — no explanation needed. Refunds are issued to the original payment method. We may decline repeated refund requests from the same account where the Service has been used in volume, but the default answer is yes. Where a charge is refunded in full, the access it paid for ends; a partial refund does not affect your plan.

We reserve the right to change pricing with 30 days notice; changes apply to the next billing cycle.

8. Acceptable use

You agree not to misuse the Service. You may not use the Service to: upload illegal content or content you don't have rights to; infringe the rights of others; attempt to reverse engineer, breach the security of, or otherwise compromise the Service; scrape or extract data for commercial redistribution; resell the Service without authorization; violate any applicable laws or regulations; or process or upload data — including sensitive personal data of others — that you have no right to access or lack proper authorization for.

9. Connected platforms

When you connect a third-party platform (e.g. Shopify, Meta, Google), your use of that platform remains subject to its own terms. You are responsible for having the rights to connect and analyze that data.

10. Your data and intellectual property

The Service, including the underlying BizFalcon Analyst engine, is owned by BizFalcon AI. You retain ownership of all data you upload to or connect with the Service. By using the Service, you grant us a limited license to process your data solely to provide the Service. You represent that you have the right to upload and process any data you submit.

11. Output: information, not advice

The Service produces analysis and recommendations from data you provide. Its output — both AI-generated insights and figures computed directly from your data — is information to inform your own decisions, and is not financial, investment, accounting, tax, or legal advice.

Figures are computed from the data you supply and from assumptions the Service discloses; they may be incomplete or inaccurate if the underlying data is. AI-generated insights may additionally be incomplete or inaccurate. Verify before acting.

You are responsible for the business decisions you make and for their outcomes, including decisions taken in reliance on the Service's recommendations. Where the Service proposes an action, you decide whether to take it.

12. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation.

13. Limitation of liability

To the maximum extent permitted by law, BizFalcon AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the fees you paid us in the 12 months preceding the claim.

14. Termination

You may stop using the Service at any time and may delete your account at any time through account settings. We may suspend or terminate your account for violation of these terms. Upon termination, your data will be deleted within 30 days.

15. Governing law

These terms are governed by the laws of the State of Texas, United States. Any disputes shall be resolved in the courts of Texas. If any provision is found unenforceable, the remaining provisions continue in effect.

16. Changes to these terms

We may update these Terms. Continued use of the Service after changes constitutes acceptance.
